Answered: CIFFO our discharge berth is the second one should the master tender nor at second discharge berth

My humble opinion is opposite. Your first NOR is valid as vsl arrived at 7 pm. But I would like to hear other opinions. I know that theoretically you're right, but I had almost similar situation and had to accept their counting!

What exactly means "Teroristic Act" and who is able to legally confirm it?

Regarding new geopolitics situation in the world, especially in chartering, if some fool attack some vsl with havy weapon it is probably not Teroristic Act, but who is in charge to define some attack as Teroristic Act from the legal point of view? This is very important also from the insurance point of view. Let's imagine such situation in international waters without any state jurisdiction! Maritime laws did not define such situation well. Many insurance companies under Force Majeure recognise only if some state's authorities proclaims Force Majeure. Lot of idiots, heavy armed, walk, fly or travel with vsl and could do some stupid thing in any given time with or without reason - although there cannot exists reason for attacking even one person! This question is pure technical issue. How would Lloyd react if they asses that there were no terrorism? But vsl is damaged, lives are lost or endengareous.

Answered: Commencement of laytime when vessel tender's NOR from previous berth working for other charterer

If previous berth can be considered as a "fixed position in port, laytime can be counted as NOR + 6.

The importation question to consider is what the Vessel did in the 5 hours 50 minutes. That determines if the vessel has tendered a valid NOR.

Answered: Laytime counting for 2nd subsequent terminal

Strictly speaking a charterer have no right to use 2 berths which is in conflict with 1 SB/SP which again is in conflict with charterers right to shift.

In any case, time runs uninterrupted until hoses disconnectted at second berth.

The owner/master only give one NOR i.e. on arrival while a second NOR for the second berth is given on behalf of charterer to his secons supplier/receiver which has no influence for owners

Answered: Why is Asbatankvoy so outdated?

The asbatankvoy C/P is a framework from which to work. Many of the clauses are ammended according to the needs of the parties involved.

A new version would require consensus, and most people feel confortable working with the existing document and simply making the ammendments they need.

Answered: what is the different between old edition and new edition asbatankvoy?

The original Asbatankvoy is updated and modified to adapt to different markets. It is normal for instance to use:

C/P: Asbatankvoy Charter Party with logical amendments incl Gasvoy cancelling clause and warrisk if any.

In the case of gas gargoes, for instance.

Answered: should Nor be tendered at disport or EOSP?

Clause 6 in Part II says:

 6 NOTICE OF READINESS

Upon arrival at customary anchorage at each port of loading or discharge, the Master or his agent shall give the Charterer or his agent notice by letter, telegraph, wireless or telephone that the Vessel is ready to load or discharge cargo, berth or no berth, ...

So NOR should be tender upon arriving as such anchorage.

Answered: Any learning resources/courses for developing charterer negotiation, sales and option-trading skills?

One good way is asking questions and participating in this website.

The problem with Shipping is that much of the training has to be done on the job. And this site is probably the closest you can get to that :D

Answered: Laytime reckoning

No. The Charterer has to provide a safe and available berth.

If there is another ship, time starts counting.

Answered: How the authenticity/originality of the CP can check?

There are companies that sell the original Asbatankvoy C/P in the famous green color.

But at the end of the day, the asbatankvoy C/P, like the other Charter Parties, it is simply a framework for a contract among the parties. Can and should be ammended to suit the parties.

You can always check the full text in our pages, in the full text of the Asbatankvopy Chater Party. But be aware that a non-modified C/P is not necessarily the best for you.

Answered: Proof of freight payment

The only proof of payment is money in the bank.

As clause 2 in Part II says:

Payment of freight shall be made by Charterer without discount upon delivery of cargo at destination, less any disbursements or advances made to the Master or Owner's agent at ports of loading and / or discharge and cost of insurance thereon.

If payment before discharging the product is not feasible because of short voyages and there is a concern about the payment, you should arrange for a payment made before loading or some other guarantee.

Edited: You can probably use tools like the Letters of Credit (LoC), asking the Charterer to place a LoC that covers the freight that would be paid upon delivery of the merchandise.

It all goes down to your relationship with the Charterer, if you trust them to pay. So if you don't think you will get your money, simply do not discharge the cargo until the money is in your bank.
